On Tuesday news emerged that the estate of the late Calypsonian, Dr. Leroy Calliste- the Black Stalin, was taken to court by photojournalist Angelo Marcelle. The case was won by Marcelle by default since the late entertainer’s wife, Janet Calliste did not appear in court. In an interview with BOOM94 entertainment, Marcelle said he is glad, in spite of everything, that the discussion on intellectual property, is happening.
Mrs. Calliste was sued as a result of the unauthorized use of a photograph of her husband, taken in 2011, by Marcelle. A judgement of over $300,000 was handed down by the judge, in favor of Marcelle.
The photo had been used on advertising material for a tribute concert held in October 2024. According to Marcelle, the image was used by Calliste without his consent despite warnings that he in fact owned the copyright for the image. Quoting his daily usage rate for print promotional material, television and social media platforms, Marcelle filed litigation for $360,000 in damages. “I am glad that intellectual property is now being discussed across the region and while things may seem a bit chaotic now because of the situation, I think the public would be better informed now, as they continue to seek more information on what intellectual property really means- their rights, their responsibilities, privileges and disadvantages,” said Marcelle.
The matter is being appealed by 77-year-old Calliste who has applied to have the ruling set aside, saying she was unaware of the legal consequences. The matter is expected to be heard by High Court Master, Wrenerson Lochan on June 1st.
