Diddy Could Be Freed Today as Legal Team Files An Appeal.

Attorneys representing Sean Combs will appear before a Federal Appeals court today to argue that his freak-offs were not a violation of the law, but instead, 'kinky porn,' which is protected by the US Constitution.

Ultimately, the end result could see the disgraced music mogul walk free.

A TMZ report highlights that Combs was convicted of the Mann Act, which prohibits the transportation of prostitutes across state lines to engage in sexual activity, however according to new claims by Combs’ attorneys, the Mann Act does not apply in his situation. “Freak-offs and hotel nights were highly choreographed sexual performances involving the use of costumes , role play and staged lighting which were filmed so Combs and his girlfriends could watch this amateur pornography later. Pornography production and viewing of this sort is protected by the First Amendment and thus cannot constitutionally be prosecuted,” say the legal team representing Diddy.

Prosecutors have deemed the claims meritless. Combs’ legal team is also arguing the 50-month sentence, saying it is out of line with sentencing guidelines and noting that the typical sentence for the crime is 15 months. Combs has served 19 months behind bars.
